1.1. User Account Information.

When you sign up for a User Account on the BeastlyAds Platform, you will be required to provide certain personal information, which may include your name, contact details, phone number, postal address, email address, date of birth, and/or profile photo, or other information, some of which will depend on the features you use. If you create a User Account on behalf of a corporation, partnership, or other legal entity, you may be required to provide certain additional information regarding that legal entity, including tax identification, corporate registration information, governing-or ownership documentation, details about your business, or other information.

1.2. Identity Information.

Where necessary and appropriate, we may ask you for an image of your government-issued ID (in accordance with applicable laws) or other verification information, and/or a selfie to verify your ID. If you provide a copy of your ID to us, we will obtain information from your ID.

1.3. Other Information You Provide.

We will also collect information necessary to provide the services on the BeastlyAds Platform when you perform certain actions, such as when you fill in a form, post or book a Listing, add information to your User Account, post a question or reply with an answer in a Q&A Exchange, communicate with BeastlyAds or other Users, or provide your address and/or geolocation.

1.4. Information Automatically Collected.

When you use the BeastlyAds Platform or connect with our Payments Partner, we may automatically collect certain information, including:

1.4.1. Geolocation Information.

Determined from your IP address, mobile or other device’s GPS, or other information you share with us, depending on your device settings. We may also collect this information when you’re not using the app if you enable this through your settings or device permissions.

1.4.2. Usage Information.

Such as searches for Listings, bookings you have made, access dates and times, the pages you’ve viewed or engaged with before or after using the BeastlyAds Platform, and other actions on the BeastlyAds Platform, including the pages or content you view and links you click to third-party websites or applications. We may collect this information even if you haven’t created a User Account or logged in.

1.4.3. Device Information.

Such as IP address, hardware and software information, device information, device event information, unique identifiers, crash data, and read receipts. We may collect this information even if you haven’t created a User Account or logged in.

1.4.4. Cookies.

To keep track of certain information, and to provide better services via the BeastlyAds Platform, we use cookies and similar tracking technologies. A cookie is a small file that is downloaded by your browser from a website and stored on your computer or mobile device. An anonymous unique identification number may also be contained in a cookie file. We also use tags, beacons, and scripts in order to collect information and improve and analyze the BeastlyAds Platform. Your browser can be configured to reject all cookies or to indicate when cookies are being sent to you. If you choose not to accept cookies, some portions of the BeastlyAds Platform may be inaccessible to you or may not operate properly.

1.5. Information We Collect from Third Parties.

We may collect information from other sources, such as:

1.5.1. Third-Party Applications.

If you choose to link, connect, or login to the BeastlyAds Platform with a third-party service, such as Google, Facebook, and WeChat, you direct the service to send us information such as your registration, friends list, and profile information as controlled by that service or as authorized by you via your privacy settings at that service.

1.5.2. Background Information Providers.

To the extent permitted by applicable laws, we may obtain, for example, reports of criminal records, sex offender registrations, and other information about you and/or your background. We may use your information, including your full name and date of birth, to obtain such reports.

1.5.3. Third-Party Tools.

We may also use third-party tools to collect information you provide to us or information about how you use the BeastlyAds Platform, and may monitor and record your mouse movements, scrolling, clicks and keystroke activity on the BeastlyAds Platform and other browsing, search or purchasing behavior. These tools may also record information you enter when you interact with the BeastlyAds Platform, including engaging in chat or other features.

1.5.4. Other Sources.

To the extent permitted by applicable law, we may receive additional information about you and your activities and interactions on and off the BeastlyAds Platform to help detect fraud and safety issues from (i) third-party service providers, including our Payments Partner, or other third parties, or (ii) other Users, individuals or members of the public, legal entities, or governmental, public, tax, or other authorities.

We may use and process your information, including by combining it with other information we have about you, for the following purposes:

2.1. Enable Your Use of the BeastlyAds Platform.

Such as to enable you to establish and access a User Account, to communicate with other Users or BeastlyAds, to use the BeastlyAds Platform, or to personalize and customize your experience with the BeastlyAds Platform, including your Search Results or preference.

2.2. Improve and Develop the BeastlyAds Platform.

Such as to perform analytics, debug, or conduct research, or develop and improve products and services provided through the BeastlyAds Platform.

2.3. Safeguard the BeastlyAds Platform, other Users, and our Employees.

Such as to detect, prevent, assess, and address fraud, safety, and security risks, including to assess or evaluate the propriety of your interactions with other Users, the BeastlyAds Platform, our employees, or members of the public. Such use may require verification or authentication of information provided by you or checks against and combination with other databases or information sources.

2.4. Legal, Contractual, or Regulatory Purposes.

Such as to enforce or protect our rights under the Terms or other agreements, or to defend against investigation, litigation, or regulatory action, including against you, other Users, or third parties, such as service providers, financial institutions, insurance companies, or government authorities, or to comply with applicable law, respond to legal requests, or otherwise to prevent harm.

2.5. Advertising and Marketing Purposes.

Such as to send you promotional and marketing messages, or other information, administer promotional activities or events sponsored or managed by BeastlyAds or its third-party partners, and analyze characteristics and preferences to send you promotional messages, marketing, advertising, and other information that we think might be of interest to you.

2.6. Provide Payment Services.

To enable payment services, including those provided by our Payments Partner, including to: detect and prevent money laundering, fraud, abuse, and security incidents, as well as conduct risk assessments, comply with legal and compliance obligations, such as anti-money laundering regulations and sanctions enforcement, enforce the terms of any relevant policies or applicable law, and to improve the provision of such services.

2.7. Analyze Your Activities and Communications.

We may review, scan, or analyze your communications and activities on the BeastlyAds Platform for any of the reasons outlined in this Section, including fraud prevention, security investigations, risk assessment, regulatory compliance, product development, research, analytics, enforcing our Terms of Service, and customer support purposes.

3.1. Listings and Profile.

The following information will be visible to any visitors to the BeastlyAds Platform, including to visitors without a User Account:

3.1.1. Information contained in your public profile; or
3.1.2. Information contained in any Listings you create.

3.2. Permitted Sharing of Your Information.

One of the core services of the BeastlyAds Platform is to facilitate the connection between Hosters and Posters for the provision of Advertising Hosting Services and the offering of Advertising Posting Opportunities. To provide these services, we may share your information with:

3.2.1. Other Users, including sharing your contact information when you or another User book a Listing or use our “Reserve and Connect” feature to negotiate the terms of a Listing; and
3.2.2. Service providers (including our Payments Partner) to help the BeastlyAds Platform provide its services, including those that help us: (i) verify your identity or authenticate your identification documents, (ii) check information against public databases, (iii) conduct background checks, fraud prevention, security investigations, and risk assessments, (iv) perform product development, maintenance, and debugging, (v) provide payments services, (vi) process, handle, or assess insurance claims or similar claims, (vii) review, scan, and analyze communications on the BeastlyAds Platform for certain purposes, such as evidence of illegal activity, or (vii) with data storage, maintenance services, database management, or web analytics. These providers are contractually bound to protect your information, have access to your information to perform these tasks, and may also disclose your information where required by law.

3.3. Consent to Sharing Your Information.

Where you provide consent or direct us to share your information with a third party, we may share your information as described at the time of your consent or direction to share that information.

3.4. Search Engines.

Information you share publicly on the BeastlyAds Platform may be indexed through third-party search engines. In some cases, you may opt-out of this sharing in your User Account.

4.1. Legal Obligations.

We may disclose your information to courts, law enforcement, governmental or public authorities, tax authorities, authorized third parties, or other Users, if and to the extent we are required or permitted to do so by law or where disclosure is reasonably necessary to: (i) comply with our legal obligations, (ii) comply with a valid legal request, such as a subpoena or court order, or to respond to claims asserted against BeastlyAds, (iii) respond to a valid legal request relating to a criminal investigation to address alleged or suspected illegal activity, or to respond to or address any other activity that may expose us, you, or any other of our users to legal or regulatory liability, (iv) enforce and administer our agreements with Users, including our Terms, (v) respond to requests for or in connection with current or prospective legal claims or legal proceedings concerning BeastlyAds and/or third parties, in accordance with applicable law, or (vi) protect the rights, property or personal safety of BeastlyAds, its employees, its Users, or members of the public.

4.2. Tax Obligations.

Where legally required or permissible according to applicable law, we may disclose your information to relevant tax authorities or other governmental agencies, for the purpose of the tax authorities’ determination of proper compliance with relevant tax obligations.

4.3. Notification.

Where appropriate and/or legally required, we may notify Users about legal requests for your information, unless: (i) providing notice is prohibited by the legal process itself, by court order we receive, or by applicable law, or (ii) we believe that providing notice would be futile, ineffective, create or perpetuate a risk of fraud, injury or harm to an individual or group, including to BeastlyAds, its employees, or our Users, or expose BeastlyAds to a claim of obstruction of justice.

4.4. Effectuate Business Transfers.

If BeastlyAds is involved in or contemplating any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction, such as due diligence. In this event, we will notify you before your information is transferred and becomes subject to a different privacy policy.

4.4. Effectuate Business Transfers.

If BeastlyAds is involved in or contemplating any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may sell, transfer, or share some or all of our assets, including your information in connection with such transaction or in contemplation of such transaction, such as due diligence. In this event, we will notify you before your information is transferred and becomes subject to a different privacy policy.

5.1. Linking Third-Party Services.

You can link your BeastlyAds account with certain third-party services, including our Payments Partner. When you direct the data sharing by creating this link information you provide to us from the linking of your accounts may be stored, processed, and transmitted for fraud prevention, security investigations, and risk assessment purposes.

5.2. Third-Party Service Terms.

Parts of BeastlyAds Platform may link to third-party services, including our Payments Partner. BeastlyAds does not own or control these third parties. When you interact with these third parties and choose to use their service, you are providing your information to them. Your use of these services is subject to the privacy policies of those providers, including, but not limited to, the Google Maps/Earth Additional Terms of Use, and The Stripe Privacy Policy.

You can access and update some of your information through your User Account. You are responsible for keeping your information up to date. If you delete your User Account, you can request that your information be deleted. You can exercise any of the rights described in this Section consistent with applicable law. We may ask you to verify your identity and request before taking further action on your request. If you request deletion of your information, or if your account is suspended, terminated, or voluntarily closed, we may retain information for the following purposes:

6.1. Legitimate Business Interests.

We may retain your information as necessary for our legitimate business interests, as determined in BeastlyAds in our sole discretion, such as for the prevention of money laundering, fraud detection and prevention, and enhancing safety, and maintaining a positive, inclusive, and safe environment for all Users and persons on the BeastlyAds Platform. For example, if we suspend a User Account for fraud or safety reasons, we may retain information from that User Account to prevent that User from opening a new User Account on the BeastlyAds Platform in the future.

6.2. Legal, Tax, Reporting, and Auditing Obligations.

We may retain and use your information to the extent necessary to comply with our legal (including potential litigation claims), tax, reporting, and auditing obligations.

6.3. Shared Information.

Information you have shared with others, such as Reviews, Q&A Exchanges, and other postings, may continue to be publicly visible on the BeastlyAds Platform, even after your User Account is deleted.

6.4. Residual Copies.

Because we take measures to protect data from accidental or malicious loss and destruction, residual copies of your information may not be removed from our backup systems for a limited period of time.

Depending on your State of residence or current location, certain State-specific data or privacy laws may apply to you—please consult your applicable State or local law for additional information on your rights under such applicable law.

We reserve the right to modify this Privacy Policy at any time in accordance with applicable law. If we do so, we will post the revised Privacy Policy and update the “Last Updated” date at the top. In case of material changes, we may also provide you with notice of the modification by email. If you disagree with the revised Privacy Policy, you can delete your User Account. If you do not delete your Account, your continued access to or use of the BeastlyAds Platform will be subject to the revised Privacy Policy.
